1. Seller and scope

The Jägermeister online shop at eu.jagermeister.com and its country domains (the "Shop") is operated by Gekko Agency B.V., Van Graftstraat 10, 3088 GL Rotterdam, The Netherlands, Chamber of Commerce (KvK) no. 81234929, VAT ID NL862006107B01 ("we", "us", "Seller"), in cooperation with Mast-Jägermeister SE, Jägermeisterstraße 7–15, 38302 Wolfenbüttel, Germany, which operates the website and owns the Jägermeister brand.

These Terms of Sale apply to all orders placed in the Shop. The Shop is intended for consumers, meaning natural persons who buy for purposes outside their trade, business or profession. If you want to buy in a professional capacity, please contact us first.

The use of the website itself is governed by the Terms of Service. The processing of personal data is described in the Privacy Policy.

2. Age requirement

You must be at least 18 years old and of legal drinking age in your country of residence to place an order.

3. Conclusion of the contract

The presentation of products in the Shop is not a binding offer but an invitation to order. By clicking the order button at the end of the checkout, you submit a binding offer to purchase the products in your cart. We confirm receipt of your order by e-mail immediately afterwards. This confirmation is not yet an acceptance of your offer. The contract is concluded when we accept your order by sending a shipping confirmation or by delivering the products.

Before submitting your order, you can review and correct your entries at any time. The contract languages are the languages offered in the Shop. If translations differ, the English version prevails, unless mandatory law provides otherwise. We store the contract text. You receive the order details and these Terms by e-mail.

4. Prices and shipping costs

All prices are stated in euros and include the statutory value added tax (VAT). Shipping costs are shown separately in the checkout before you place your order. For deliveries to countries outside the European Union, local customs duties and import taxes may apply. These are payable by you.

If a price is obviously wrong because of a technical or typing error, we may decline the order. In that case we refund any amount already paid without delay.

5. Payment

The available payment methods are shown in the checkout. Payment is due when the order is placed. We may decline an order if a payment method cannot be verified.

6. Delivery

We deliver to the countries that can be selected as delivery address in the checkout. Delivery times and methods are set out in the Shipping Policy. Unless otherwise stated, we ship within 30 days of the conclusion of the contract at the latest. We cannot deliver to PO boxes.

The risk of accidental loss or damage passes to you when the products are handed over to you or to a person you have designated.

7. Retention of title

The products remain our property until full payment has been made.

8. Right of withdrawal

As a consumer, you have a statutory right of withdrawal of fourteen (14) days. Details, exceptions and the model withdrawal form are set out in our Returns & Right of Withdrawal policy.

9. Warranty

The statutory warranty rights for lack of conformity apply. If a product arrives damaged, incomplete or incorrect, please contact us as soon as possible by e-mail to jagermeister@gekkoagency.com, phone +31 6 21859868 or via the contact form at eu.jagermeister.com/pages/contact, if possible with photos. This helps us resolve the issue quickly. It does not affect your statutory rights.

10. Liability

We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under mandatory product liability law. In all other cases our liability for slight negligence is limited to the breach of essential contractual obligations and to the foreseeable damage typical for this type of contract. Nothing in these Terms limits your statutory consumer rights.

11. Intellectual property

All content in the Shop, including brand names, trademarks, images, texts and videos, is the property of Mast-Jägermeister SE or its licensors and may not be used without prior written consent.

12. Applicable law and jurisdiction

These Terms and all contracts concluded through the Shop are governed by the laws of the Netherlands, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer, you also keep the protection of the mandatory provisions of the law of your country of habitual residence. Statutory rules on jurisdiction for consumers remain unaffected.
